BY ACCESSING THE BILLYDOE MEATS WEBSITE (http://www.billydoemeats.com/), RELATED WEBPAGES, OR MOBILE APPLICATIONS (COLLECTIVELY, THE “SITE”), CREATING AN ACCOUNT WITH BILLYDOE MEATS, AND/OR UTILIZING ANY BILLYDOE MEATS SERVICES (THE “SERVICES”), YOU ACKNOWLEDGE YOU HAVE READ AND WILL COMPLY WITH THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY (THE “POLICY”).  This Policy is in addition to THE terms, conditions, and restrictions contained in the BILLYDOE MEATS TERMS OF USE.  All capitalized terms used in this Policy that are not defined herein shall have the meanings given to them in the TERMS OF USE.  


What Does This Privacy Policy Cover?

The Site is owned by BillyDoe Meats. This Policy applies to all BillyDoe Meats account holders and anyone using an BillyDoe Meats account, the Site, and/or Services (collectively, a “User”). This Policy is designed to explain how BillyDoe Meats treats and uses information that it collects and receives about any User, including the Personal Information or Business Information (as defined below) collected through the Site and the various features, Services, and software that BillyDoe Meats uses or offers. 

 

What is Personal Information?

Personal information is any information that specifically identifies a User or an individual.  For example, personal information may include, but is not necessarily limited to, a name, address, telephone number, email address, employment information, driver’s license number, social security number, billing information, customer inquiry and support contact, banking information, credit card or other account number, data/information provided or transmitted by a User while using the Services, domain names, IP addresses, and information about a User’s activities when directly linked to that person, such as information about his or her purchases.  Personal information also includes demographic information such as date of birth, gender, geographic area, preferences, and any other personally identifiable information (collectively, “Personal Information”).   

 

What is Business Information?

Business information is any information that specifically identifies a User or a specific business.  For example, business information may include, but is not necessarily limited to, a name, address, telephone number, email address, company information, FEIN number, billing information, customer inquiry and support contact, banking information, credit card or other account number, data/information provided or transmitted by a User while using the Services, domain names, IP addresses, and information about a User’s activities when directly linked to that business, such as information about such business’s activities or purchases (collectively, “Business Information”).  

 

Non-Identifiable Information

BillyDoe Meats also may collect certain non-identifiable information when you visit the Site. This information includes the type of Internet browser and operating system you are using, the domain name of your Internet service provider, the URL that you visited before you came to our Site, the URL to which you next go, and your IP address, pages visited, and average time spent on our Site. This information may be used, for example, to alert you to software compatibility issues, or it may be analyzed to improve our Site design and functionality. When you use the contact features of the Site, you consent to the review and internal use of your communication by BillyDoe Meats.

 

Moreover, Personal Information or Business Information does not include “aggregate” information.  Aggregate information is data we collect about a group or category of products, services or customers, from which personally identifiable information has been removed.  In other words, information about how a customer uses Services may be collected and combined with information about how others use the same Services, but no personal information will be included in the resulting data.  Likewise, information about the products/services a customer purchases or uses may be collected and combined with information about the products/services purchased or used by others.  Aggregate data helps us understand trends and customer needs so that we can better consider new products and services, and tailor existing products and services to customer demands.

 

How We Use Personal Information and Business Information.

BillyDoe Meats may use, store, process, and/or collect Personal Information or Business Information to process Users’ requests or transactions and provide Services or to inform Users about other products or Services we think may be of interest.  When Users access the Site, BillyDoe Meats may use “cookies” to track or identify such Users.  If BillyDoe Meats uses Personal Information or Business Information in our internal marketing efforts, BillyDoe Meats will provide Users with certain opt-out choices (see below), and will not disclose Personal Information or Business Information to third parties except as described in this Policy. BillyDoe Meats may also receive information from third parties with which we have business relationships, and will combine this information with the other Personal Information or Business Information we maintain about Users. In such cases, this Policy shall govern such information.

 

Sharing of Personal Information or Business Information.

Except as described in this Policy, BillyDoe Meats will not sell, rent, or share Personal Information or Business Information with third parties without a User’s prior consent.  BillyDoe Meats may share Personal Information or Business Information with third-party vendors who assist us in performing internal functions necessary to operate BillyDoe Meats’s business.  In all cases, BillyDoe Meats limits Personal Information or Business Information shared with third parties to that which is necessary to carry out those functions.  Moreover, BillyDoe Meats requires third parties to comply with BillyDoe Meats’s privacy practices and keep Personal Information or Business Information confidential and prohibits them from using it for other purposes except as required by law. BillyDoe Meats shall not be responsible for any additional information provided by any User directly to these parties, and we encourage Users to become familiar with such parties’ policies and practices before disclosing any information directly to them.

 

BillyDoe Meats may disclose Personal Information or Business Information, without prior notice to a User, when we believe it is necessary to comply with federal, state, and local laws, rules, and regulations (e.g., a lawful subpoena, warrant, or court order); to enforce and/or apply this Policy or our other policies or agreements; to initiate, render, bill, and collect amounts owed to BillyDoe Meats; to protect Users’ rights, property or safety; to protect Users from fraudulent, abusive, or unlawful use of the Site; or, in compliance with the Electronic Communications Privacy Act of 1986 (ECPA), if BillyDoe Meats reasonably believes that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.   

 

In addition, Personal Information or Business Information about Users, including personally identifiable information, may be disclosed as part of any merger, acquisition, debt financing, sale of BillyDoe Meats assets, or sale of ownership interests in BillyDoe Meats, as well as in the event of an insolvency, bankruptcy, or receivership in which personally identifiable information could be transferred to third parties as one of BillyDoe Meats’s business assets.  The ECPA provides for exceptional circumstances under which BillyDoe Meats may be compelled or permitted to disclose Personal Information or Business Information about a User or the content of his or her communications.  For example, the content of a User’s email or other communications may be disclosed to law enforcement agencies if it appears to be evidence of child pornography or if it was inadvertently obtained by BillyDoe Meats and appears to pertain to the commission of a crime.  BillyDoe Meats will disclose Personal Information or Business Information about a User when required by law or legal process.

 

The Social Security Act (SSA) provides that state welfare agencies may obtain from our subscriber lists the names and addresses of individuals who owe or are owed child support and the names and addresses of their employers.  The SSA states that such information can be obtained through an administrative subpoena issued by a state welfare agency, without court order, and does not require that a customer be given notice of, or the opportunity to, contest the disclosure of any such information.  BillyDoe Meats will disclose Personal Information about a User when required by law or legal process.  Sometimes, a copyright or intellectual property (“Property”) owner believes that their Property rights have been infringed by an internet user who uses an online service to post, download, or otherwise use the Property without permission.  The owner may know some information, such as the user’s email address or IP address, but may not know the user’s true identity.  The Digital Millennium Copyright Act provides procedures for a Property owner to obtain a subpoena seeking disclosure from an online service provider of the identity of a user who is believed to have infringed on such owner’s Property rights.  Upon receipt of a subpoena, the online service provider is required to expeditiously identify the alleged infringer.  BillyDoe Meats will comply with this legal obligation.

 

Personal Information of Persons under Age 13.

You must be at least eighteen (18) years of age to use our Site. In accordance with the Children’s Online Privacy Protection Act of 1998, BillyDoe Meats does not knowingly collect Personal Information from anyone under the age of 13.  All Users must implement security, safety, and preventive measures and protocols to prevent any Persons under the age of 13 from submitting Personal Information to BillyDoe Meats.  If BillyDoe Meats is aware that a person under the age of 13 submits Personal Information to BillyDoe Meats, BillyDoe Meats will promptly delete such Personal Information as soon as BillyDoe Meats discovers the submission.  Parents, legal guardians, and adults supervising children are strongly encouraged to take an active supervisory role in their children’s use of the Internet, and to inform them of the potential dangers of providing any information or Personal Information over the Internet.

 

Links to Other Web Sites.

The Site may contain links to other websites.  Any Personal Information or Business Information provided on such linked pages is provided directly to that third party and is subject to that third party’s privacy policy. BillyDoe Meats will not be responsible for the content or privacy and security practices and policies of websites to which we link.  Links from the Site to third parties or to other sites are provided for Users’ convenience.  We strongly encourage Users to carefully review and understand each third party’s privacy and security practices and policies before providing them with any Personal Information or Business Information.

 

Choice to Opt-Out.

We give you the following options to opt-out of receiving communications from BillyDoe Meats; to request that we correct or delete your Personal Information; or, in the event that we share your Personal Information with any third parties for their own marketing purposes, to opt-out of such disclosure.  To opt out, customers may email us at sales@billydoemeats.com.

 

Confirmation of Opt-Out Request.

Users will receive email or written confirmation of opt-out requests.  If no confirmation is received from BillyDoe Meats within thirty (30) days from submission of an opt-out request, Users are instructed to promptly contact BillyDoe Meats customer service to verify BillyDoe Meats’s receipt and implementation of such opt-out request.

 

Security

We have attempted to take all reasonable steps to have physical, electronic and procedural safeguards in place to protect Personal Information or Business Information gathered through the Site. This includes compliance with related federal regulations and may include use of industry-standard Secure Socket Layer (SSL) encryption to prevent any loss, misuse, unauthorized access, disclosure, or modification of personal information. Unfortunately, we cannot guarantee transmission over the internet to be 100% secure. As a result, while we strive to protect your Personal Information or Business Information, we cannot guarantee or warrant the security of any information you transmit to or from our Site, and you do so at your own risk.

 

Public Information

Any information Users submit through a public forum, such as a comment or chat board, forum or social media channel can be read, collected, or used by us and others, including, for example, to personalize Users’ experience on our Site. Users are responsible for the information they disclose in these forums and such information is not protected under this Policy.

 

Policy Changes.

This Policy is subject to change with limited notice.  This Policy may change, at any time, with limited notice to Users.  Any changes will be incorporated into the Policy posted to the Site, and you will be bound by such changes as of the date of such changes.  If any part of this Policy is held invalid or unenforceable, that portion of this Policy shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
